only thing i could see in hindsight when the cop first started firing there was somebody else in the passenger seat of the van directly in the line of fire BUT! he did what he had to do, the perp made it a deadly situation so he paid the price for his stupid actions

It's simple, if you're running and you keep the gun in your hand, you're looking for a tactical cover, if you drop your weapon and run, you're retreating.

Officers are trained not to let armed and dangerous persons flee into public. Most of the time, being shot in the back makes no difference if a gun is involved first.
